Um passo decisivo para a democratização do setor elétrico foi dado pelo presidente Luiz Inácio Lula da Silva nesta quarta-feira (12/08/2026). Com a assinatura de um novo decreto, o governo federal abre caminho para que pequenos e médios consumidores possam escolher livremente seu fornecedor de energia, em um modelo semelhante ao que já acontece com os serviços de telefonia.

A medida representa um avanço significativo nos direitos do consumidor e na modernização do mercado. A partir de novembro de 2027, clientes comerciais e industriais de baixa tensão (inferior a 2,3 kV) poderão migrar para o Ambiente de Contratação Livre (ACL). Em novembro de 2028, o benefício será estendido a todos os consumidores residenciais, garantindo mais autonomia e potencial de economia na conta de luz.

Para assegurar uma transição segura e organizada, a Agência Nacional de Energia Elétrica (Aneel) será a responsável por regulamentar o processo, estabelecendo regras claras de informação e proteção ao consumidor. O decreto também prevê a figura do Supridor de Última Instância (SUI), um mecanismo de segurança que garante o fornecimento de energia caso a empresa escolhida pelo cliente deixe de operar. Inicialmente, essa função será exercida pelas atuais distribuidoras.

A iniciativa faz parte de uma agenda mais ampla e robusta de políticas públicas voltadas para a sustentabilidade e a transição energética. No mesmo evento, o presidente assinou outros três decretos que consolidam a liderança do Brasil na economia verde. Foram criados o Programa Nacional de Combustível Sustentável de Aviação (ProBioQAV), que estabelece a meta de reduzir em 10% as emissões do setor aéreo até 2037, e o Programa Nacional do Hidrogênio (PNH2), que estrutura o mercado de hidrogênio de baixa emissão de carbono no país.

Além disso, foi estabelecido o marco regulatório para a atividade de captura e armazenamento geológico de carbono, uma tecnologia fundamental para a descarbonização da indústria nacional. As novas regras demonstram o compromisso do governo em aliar desenvolvimento econômico com responsabilidade ambiental, posicionando o Brasil na vanguarda das soluções para a crise climática.
